Privacy Policy of AJS PARTS SP. Z O.O. SP. K.

 

General Information

  1. This Privacy Policy (hereinafter referred to as the “Policy”) informs about the ways and principles concerning the processing of personal data of Users of services offered by AJS Parts Sp. z o.o. sp.k. and visitors to the websites of AJS Parts Sp. z o.o. sp.k.

  2. At AJS Parts Sp. z o.o. sp.k. we attach particular importance to respecting the privacy of all persons, therefore personal data of the Users of the services offered by us and information about the visitors to our Web pages are used only and exclusively for the purposes for which they were collected for no longer than it is necessary for these purposes.

  3. AJS Parts Sp. z o.o. sp.k. reserves the right to introduce changes, modifications of functionalities or features of the web pages administered by the Company, to transfer the rights to the Web pages and to perform any legal actions allowed by the applicable law. Any changes made by AJS Parts Sp. z o.o. sp.k. to the Websites administered by the Company may not violate the rights of their Users.

 

Glossary

  1. Personal Data Controller – AJS Parts Sp. z o.o. sp.k., ul. Racławicka 154/19, 02-117 Warszawa.

  2. Personal data – means any any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

  3. User – means any person who visits the websites of the Personal Data Controller or uses the services offered by the Personal Data Controller.

  4. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation).

  5. Website – the Website www.ajsparts.pl operated by the Personal Data Controller.

  6. Policy – this document.

  1. In the event that any Websites administered by AJS Parts Sp. z o.o. sp.k. are linked to other Web pages or Websites, we are not responsible for the privacy management rules that apply there.

  2. When you access the Web pages or Websites linked to the Web pages of AJS Parts Sp. z o.o. sp.k. we recommend that you familiarise yourself with the privacy policies and information obligations posted on them.

Cookies

  1. On our Web pages of AJS Parts Sp. z o.o. sp.k. we do not seek to identify Users and this is not our purpose. Exceptions to this are the forms dedicated to contact and booking, which are voluntary.

  2. The Websites administered by AJS Parts Sp. z o.o. sp.k. or some of their elements may use so-called “cookies”. These are small files containing computer data, in particular text files, which are stored on the User's terminal device on which the Website is viewed (e.g. computer, telephone, laptop, tablet, etc.).

  3. Cookies make it possible, among other things, to adapt the browsed website to the User's needs and preferences, and also serve AJS Parts Sp. z o.o. sp.k. for statistical purposes. Cookies are not used to identify Users and on their basis the identity of the person browsing the Website is not established.

  4. The cookies used on www.ajsparts.pl are not harmful to the User's terminal device. Most Web browsers accept the storing of cookies by default.

  5. In order to change the use of cookies, it is necessary to change the settings of the browser used by the User. How to change the use of cookies varies depending on the type of browser. Detailed information on how to delete cookies should be found in the tab of the browser used by the User.

  6. The Websites managed by AJS Parts Sp. z o.o. sp.k. use two types of cookies:

  • session” – temporary files that are stored on the User's terminal equipment until they log out or leave the Website,

  • persistent” –- files stored on the User's terminal equipment for the time specified in the parameters of the User's browser or until they are physically deleted by the User.

  1. AJS Parts Sp. z o.o. sp.k. analyses activity on its Websites in the form of profiling using cookies in order to create and present you with dedicated offers tailored to your preferences as much as possible. The result of these may be a favourable, temporary offer addressed to you on the basis of your history of use of our services and your behaviour on the Websites administered by AJS Parts Sp. z o.o. sp.k.

  2. By means of the cookie technology used on our Websites, it is possible to learn about the preferences of Users (e.g. by analysing how often they visit our Website or which products they most frequently view), so that AJS Parts Sp. z o.o. sp.k. may present the User with advertising tailored to the User and create and present offers intended for the User.

  3. The settings of the browser used by the User allowing the storage of cookies means that the User agrees that these cookies may be stored on User's terminal device.

  4. At any time, the user has the possibility to define the conditions for the use of cookies and to restrict AJS Parts Sp. z o.o. sp.k. access to them by means of the settings of their Web browser.

  5. If you do not agree to the collection of data via cookies, you may block the placement of these cookies at any time using the options available in your Web browser or delete them.

  6. Blocking the placement of cookies or deleting them may hinder the use of www.ajsparts.pl, or even prevent you from using some of its options.

  7. AJS Parts Sp. z o.o. sp.k. does not collect cookies of the Users of the pages it manages in order to identify them, but monitors information about them using the Google Analytics tool, which helps analyse Users’ behaviour. Google Analytics collects information anonymously, which does not allow the identification of data subjects.

  8. Any User who does not agree to the use of cookies is obliged to modify the settings of their Web browser. The configuration of the system to allow the use of cookies implies consent for the Service Provider to store the information referred to in paragraph 2, in accordance with Article 173(2) of the Telecommunications Law of 16 July 2004.

Data protection and duty of information

In order to ensure the integrity, availability and confidentiality of personal data, the Data Controller has implemented procedures allowing access to personal data only to authorised persons and only to the extent that it is necessary for them to perform their official activities. The Data Controller applies organisational and technical solutions to ensure a secure and lawful processing of personal data.

  4. We collect the following personal data when providing our services:

  • first name(s) and surname

  • telephone number

  • E-mail address

  • address

  • name and address of the Company/Business

  • Tax Identification Number (NIP)

  1. AJS Parts Sp. z o.o. sp.k. processes your personal data for following purposes:

  • to conclude and perform the Agreement(s) between you and AJS Parts Sp. z o.o. sp.k. in accordance with Article 6(1)(b) GDPR,

  • to carry out ongoing communication and send responses to your requests, enquiries and applications in accordance with Article 6(1)(f) GDPR, where the legitimate interest consists of ongoing communication with customers,

  • proper service by AJS Parts Sp. z o.o. sp.k. including for the purpose of resolving your case electronically, including by contacting you on the site's messenger or on social media as well as by telephone in accordance with Article 6(1)(f) GDPR, where the legitimate interest lies in the proper service of the Customer,

  • to handle complaints in accordance with Article 6(1)(f) GDPR, where the controller's legitimate aim is to handle the complaint,

  • to send marketing and commercial information from business partners via e-mail, SMS, MMS in accordance with Article 6(1)(a) GDPR,

  • marketing of the goods and services of AJS Parts Sp. z o.o. sp.k. and satisfaction surveys for services provided in accordance with Article 6(1)(f) GDPR, where the data controller's legitimate interest is the marketing of its products and services,

  • the dispatch of a newsletter pursuant to Article 6(1)(f) GDPR, where the controller's legitimate interest is the marketing of its products and services,

  • If you agree to receive marketing communications to your e-mail address, the legal basis is also Article 10 of the Act of 18.07.2002 on the provision of electronic services, and if you provide us with your telephone number for this purpose then Article 172 of the Act of 16.07.2004 - Telecommunications law

  • to conduct social media competitions in accordance with Article 6(1)(f) of the GDPR is the legitimate interest of the controller to organise, conduct the competition, enable Participants in the competition to take part in it or defend against and assert possible claims,

  • to conduct the operational activities of AJS Parts Sp. z o.o. sp.k. (e.g. analyses, reports, statistics, verification of payment reliability, etc.) pursuant to Article 6(1)(f) GDPR,

  • the establishment, defence and assertion of claims pursuant to Article 6(1)(f) GDPR,

  • fulfilment of AJS Parts Sp. z o.o. sp.k.'s legal obligations resulting from other legal regulations (e.g. providing information to authorities entitled to request it, fulfilling court decisions, cooperation with insurers, etc.) in accordance with Article 6(1)(c) GDPR,

  • to respond to the data subject's request in accordance with Article 6(1)(f) GDPR.

  • for archival purposes in accordance with Article 6(1)(c) GDPR.

  1. If we receive data from entities cooperating with AJS Parts Sp. z o.o. sp.k. as part of the provision of personal data to us, we inform you in accordance with Article 14 GDPR that we may also process the data for the above purposes. We then apply the same requirements which are described in this Privacy Policy.

  2. Furthermore, we inform AJS Parts Sp. z o.o. sp.k. is entitled to verify the user's payment credibility in cooperation with Krajowy Rejestr Długów Biuro Informacji Gospodarczej S.A. (KRD BIG). AJS Parts Sp. z o.o. sp.k. is entitled to make the conclusion of a contract with a user dependent on his/her verification in KRD BIG. The basis for verification of the consumer's payment credibility by applying to KRD BIG for disclosure of business information is an authorisation granted by the consumer. The authorisation is granted by the user's consent to verify his/her payment credibility with KRD BIG. The legal basis for the above action is 24 section 1 of the Act on Disclosure of Business Information and Exchange of Business Data. If the consumer does not agree to the verification, AJS Parts Sp. z o.o. sp.k. has the right to refuse to conclude an agreement with the user. In order to obtain information about the user's payment reliability, AJS Parts Sp. z o.o. sp.k. will process the user's PESEL or NIP number. AJS Parts Sp. z o.o. sp.k. is entitled to store the obtained data up to 60 days after their acquisition.

  3. AJS Parts Sp. z o.o. sp.k. entrusts the processing of personal data to the following processors:

  4. Recipients of your personal data may be:

  • persons and entities providing services for the purpose of conducting the Data Controller's business authorised by AJS Parts Sp. z o.o. sp.k. (our employees, associates, business partners, service providers, in particular in the field of IT, etc.),

  • authorised state authorities and other institutions on the basis of applicable legislation,

  • business information offices,

  • purchaser of the claim.

  1. AJS Parts Sp. z o.o. sp.k. does not transfer data outside the EEA, but if it would be necessary we will apply the necessary level of protection in accordance with Chapter V GDPR.

  2. In the event that AJS Parts Sp. z o.o. sp.k. processes personal data based on the legitimate interest of AJS Parts Sp. z o.o. sp.k., the personal data shall be processed until there is this legitimate interest in processing the personal data for a specific purpose; however, the data shall not be processed if the Customer raises a legitimate objection to such processing and AJS Parts Sp. z o.o. sp.k. fails to demonstrate the existence of valid legitimate grounds for the processing or grounds to establish, assert or defend claims.

  3. If AJS Parts Sp. z o.o. sp.k. processes personal data:

  • based on the Client's consent, such personal data will be processed until the consent is withdrawn. The withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

  • in connection with cookie technology – such personal data will be processed until such cookies are deleted using the settings of the browser or other device by the User.

  1. AJS Parts Sp. z o.o. sp.k. will keep your data only for the time necessary to fulfil the purposes set out in point 6 above and they will be stored for up to the period necessary for the performance of the Agreements and obligations between the Parties, the period required by law and the period of document retention for tax, accounting and archival purposes. The data processing period may be extended if the processing is necessary for the establishment and assertion of possible claims or the defence against claims, and thereafter only if and to the extent required by law. After the end of the processing period, the data are irreversibly deleted or anonymised.

  2. AJS Parts Sp. z o.o. sp.k. shall cease processing your personal data if you raise a legitimate objection to such processing and the Data Controller fails to demonstrate the existence of valid legitimate grounds for the processing or grounds for establishing, asserting or defending claims.

  3. The provision of your personal data is voluntary, but necessary for the above-mentioned purposes.

  4. You have the right to:

  • access to and obtain a copy of your data in accordance with Article 15 GDPR;

  • rectify your data in accordance with Article 16 GDPR;

  • delete your data in accordance with Article 17 GDPR;

  • restrict the processing of your data in accordance with Article 18 GDPR;

  • the portability of your data in accordance with Article 20 GDPR;

  • object to the processing of your data in accordance with Article 21 GDPR.

You also have the right to lodge a complaint with the supervisory authority: UODO, ul. Stawki 2, Warszawa

Where personal data is processed for the purposes of direct marketing, the data subject shall have the right to object at any time to the processing of personal data concerning him or her for such marketing, including profiling, to the extent that the processing is related to such direct marketing.

 

Final provisions

  1. AJS Parts Sp. z o.o. sp.k. applies policies and procedures to safeguard personal data against unauthorised loss, misuse, alteration or destruction in accordance with applicable laws.

  2. AJS Parts Sp. z o.o. sp.k. reserves the right to change the content of this Policy, in particular in the event of a change of applicable laws, new guidelines of supervisory bodies responsible for supervising the lawfulness and safe processing of personal data, and implementation of best practices applied in the area of personal data protection. The User will be informed of such change by posting the new content of the Policy on the relevant Website.

  3. In the event of any contradictions or doubts between the content of the Policy and the consents given by the Customer, regardless of the content of the Policy, the basis for taking and determining by AJS Parts Sp. z o.o. sp.k. the scope of activities shall be the consents voluntarily given by the User or generally applicable provisions of law.

  4. This document is for general and informational purposes only, it is not the source of the User's obligations and, in particular, does not constitute any Contract and/or Terms and Conditions.
